James F. Diviney

Mr. Diviney earned his undergraduate degree from St. John’s University (Summa Cum Laude) and his Juris Doctorate from St. John’s University School of law. He began his legal career as a Deputy County Attorney with the Nassau County Attorney’s Office in Mineola, New York.

Thereafter, he was a senior trial associate with a Long Island personal injury defense firm representing the interests of a large self-insured Long Island municipality as well as the interests of numerous insurance companies. Prior to joining Baxter Smith & Shapiro, Mr. Diviney was a senior trial associate with an established, prominent Manhattan defense firm, handling premises liability, Labor Law/construction and some medical malpractice matters. Mr. Diviney has extensive experience in all aspects of personal injury litigation including trials, mediations/arbitrations, depositions and motions. At Baxter Smith & Shapiro he concentrates his practice on the defense of a variety of premises, general liability, auto and Labor Law cases. He has been admitted to the New York State bar since 1988 and the United States District Court, Southern and Eastern Districts since 1994.
